To be honest, when I enrolled in this DLP about R.A. 6713 I was only concerned with the certificate that I will earn to be used in my quest for promotion. It was when I started reading the content of the book that I began to realize the importance of R.A. 6713 to myself as a public servant. Everything in it is a must to be learned. Lesson 1 enumerated the norms of conduct namely: commitment to public interest, professionalism, justness and sincerity, political neutrality, responsiveness to the public, nationalism and patriotism, commitment to democracy and simple living. These were thoroughly explained with the help of some situations. I became absorb with the reflection for deepening wherein I was able to give my own point of view regarding the stated questions. It was a meaningful experience to organize my thoughts and ideas. It was really good that the questions were directed to me as a public servant. I became more aware of my duties and responsibilities and that these should be discharge with high standard of ethics. Sometimes, the norms were overlooked by others. This was a good reminder and guide for us in the public service. R.A. 6713 will really strengthen good value system in the bureaucracy which is very beneficial to the public and to our country as well. If we will all be committed and dedicated to imbibe in our lives these norms, there will be good relationships between the people and government officials and employees. The people will continue to support the different activities or programs of the government because they trust their officials. We will work hand in hand to achieve our ultimate goal of improving our country. Lesson II provided me with knowledge with regards to the prohibited acts and transactions, the system of incentives and awards, duties and responsibilities of public officials and employees, about divestment and penalties under the Code. I would say that from this lesson, I became more familiarize about the things I didn't know before. These are the things that public employees must know because of the nature of our work. The different learning I've gained was very important for me as a public servant especially with the prohibited acts and transactions. This I believe would be my guide in discharging my duties and functions so all my decisions will all be legal so as to prevent any violations on the Code. Lesson III was very meaningful since all the case studies presented were very timely. I was given an opportunity to express my ideas and opinions regarding the situations. I would say that the insights I have drawn from this will be used and applied for better public service.

Fundamental Concepts in Ethics Jollie N. Alson, JD, DEM, PhD The Role of Religion Ethics transcends religion, particularly when religion is defined as a fundamental belief in a Supreme Being commonly characterized as divine, powerful and manifested in various ways understandable in a socio-cultural context of a society. The latter explains why many experience contradictions in religious beliefs. We see religion’s Supreme Bring, like Bathala, God, Allah, Jehovah, El Shaddai, Elohim, Christ, among others, in many dimension of truth as we believe they manifest in a way understandable in our limited sense of perception. Ethics is a science and has dependence in the rational investigation of truth in contrast to religion which is a system of belief and practices inferred from faith and revelation. Religious beliefs as overt manifestations of doctrines of a religion may affect application and implications of ethical norms and principles but should not substantially alter them. Religion contributes to the teaching of Ethics and continually enriches it with moral insights, as it provides direction and motivation for our moral life. This implies existence of: a). Universal ethical principles, and b). Specific ethical principles. These two should complement each other. In case of contradiction, it is prudent to decide in favor of the universally accepted principles. Ethics should be a unifying factor of all religions and should fortify religious specific beliefs. It is true that one cannot dichotomize Ethical principles from religious doctrines and Ethical standards from Religious beliefs for in the realities of life they are intertwined and only trained mind and sensitive heart can differentiate. The fact remains: one should have an anchor on religion in order to appreciate the essence of ethical principles and practices.

Ethical conducts of public servants is reinforced by political commitment. This difficult to benchmark, has been demonstrated by some policy and pronouncements. It is essential to the proper conduct and operation of government that public officials be independent and impartial and that public office not be used f public interest, therefore, requires that the law protect against any conflict of interest and establish standards for the conduct of elected officials and government employees in situations may exist. RULES as an Ethical Basis We believe in them as coming by divine revelation.  With authority or of our community.

RESULTS as an Ethical Basis The utilitarian principle focuses our attention on results or the consequences of our actions. It has been expressed traditionally as “Seeking the Greatest Good for the Greatest Number”

RELATIONSHIPS as an Ethical Basis Confucius’ “Golden Rule” of caring: “Do not do to others what you would not have them do to you”. Jesus Christ’s expression of LOVE: “In everything, do to others as you would have them do to you”.

TRADITION as an Ethical Basis Traditional Ethics – the ethics of earlier generations that is based on tradition. It is right to act in certain way because that is what it has always been done.

RULES as an Ethical Basis • Section 1, Article XI, 1987 Constitution – Public Office is a Public Trust. Public Officials and employees must at all times serve the people with utmost responsibility, integrity, loyalty and efficiency, act with patriotism and justice, and lead modest lives.” • Section 28, Article II, 1987 Constitution – The State shall maintain honesty and integrity in the public service and take positive and effective measures against graft and corruption.

RULES as an Ethical Basis RA 3019 “Anti-Graft and Corrupt Practices Act” (Anti-Graft Law) enacted in 1861

Graft is defined as “the acquisition of gain or advantage by dishonest, unfair or sordid means, especially through the use of one’s position or influence in politics, business, etc.” (People vs. Bernales, September 3, 1968)

Graft and corruption is an act or omission involving breach of the rules of decency, honesty and efficiency, for the purpose of obtaining undue advantage at the expense of the government-owned resources. In our legal system, graft and corruption is basically a crime. BALDRIAS, Napoleon S. “The Legal Implications of Graft and Corruption”

Corruption is “an act done with an intent to give some advantage inconsistent with official duty and the rights of others. It includes bribery, but it is more comprehensive, because an act may be corruptly done through the advantage to be delivered from it be not offered by another.” (Magallanes vs. Provincial Board, 66 O.G. 7839)

Corruption is the perversion or destruction of integrity of fidelity in discharging public duties and responsibilities by bribery or favor. It entails the use of public power for private advantage in ways which transgresses some formal rule of law. (Tendero)

RULES as an Ethical Basis RA 6713 “Code of Conduct and Ethical Standards for Public Officials and Employees” signed into law by then President Corazon C. Aquino on February 20, 1989

RA 6713 Rule X. Grounds For Administrative Disciplinary Action • Directly or indirectly having financial and material interest in any transaction requiring the approval of his office.

RA 6713 Owning, controlling, managing or accepting employment as officer, employee, consultant, counsel, broker, agent, trustee, or nominee in any private enterprise regulated, supervised or licensed by his office, unless expressly allowed by law.

RA 6713 Engaging in the private practice of his profession unless authorized by the Constitution, law or regulation, provided that such practice will not conflict or tend to conflict with his officials functions.

RA 6713 Recommending any person to any position in a private enterprise which has a regular or pending official transaction with his office.

RA 6713 • Soliciting or accepting, directly or indirectly, any gift, gratuity, favor, entertainment, loan or anything of monetary value which in the course of his official duties or in connection with any operation being regulated by, or any transaction which may be affected by the function of his office.

RA 6713 • Unfair discrimination in rendering public service due to party affiliation.

RA 6713 • Disloyalty to the Republic of the Philippines and to the Filipino people. • Failure to act promptly on letters and requests within 15 working days from receipt, except as otherwise provided in these Rules.

RA 6713 • Failure to attend to anyone who wants to avail himself of the services of the office or to act promptly and expeditiously on public personal transactions. • Failure to file sworn statements of assets, liabilities and networth, and disclosure of business interests and financial connections.

RULES as an Ethical Basis RA 9485 “Anti-Red Tape Act of 2007” signed into law by Pres. Gloria Macapagal-Arroyo on June 02, 2007

Violations • Refusal to accept application and/or request within the prescribed period or any document being submitted by a client. • Failure to act on an application and/or request or failure to refer back to the client a request which cannot be acted upon due to lack of requirement/s within the prescribed period.

Violations • Failure to attend to clients who are within the premises of the office or agency concerned prior to the end of official working hours and during lunch break. • Failure to render frontline services within the prescribed period on any application and/or request without due cause.

Violations • Failure to give the client a written notice on the disapproval of an application or requests. • Imposition of additional irrelevant requirements other listed in the first notice.

Violations Grave Offense • Fixing and/or collusion with fixers in consideration of economic and/or other gain or advantage. Rule X.
