Social media was designed to simplify socialization and communication online, but the outcome is unchecked control of the flow of conversation in favor of a specific agenda, profit, and violation of individual rights.

Secondly, not all internet elements utilize artificial intelligence as extensively as social media platforms. The use of AI allows such companies to fine-tune one typology of information consumed, which means that it is social media that makes decisions for its users. While the internet is a library of knowledge, where a person makes a clear choice on what to read, watch, listen to, or interact with, social media uses AI and complex algorithms to influence its user. The underlying business model of all social media platforms is to learn about its user as much as possible and profit from them in a targeted manner. Such a design is not an inherent feature of the internet, which is not constrained to be profitable in this manner since many websites operate through subscriptions, direct sales, or other means. When it comes to such dangers, AI itself can also be a problem. It is stated that “there are indeed concerns about the near-term future of AI —algorithmic traders crashing the economy, or sensitive power grids overreacting to fluctuations and shutting down electricity for large swaths of the population” (Littman 314). In other words, social media’s extensive use of AI in combination with its problematic business model creates a host of issues that are not attributable to the internet.

Thirdly, in addition to social media-specific problems, they are also linked to harms associated with both devices and the internet in general. As stated before, the internet has its harms and benefits, but the latter usually outweighs the former. Similarly, devices come with harms as well as benefits, where the balance is tilted towards the positive aspects. However, not only social media has its inherent design flaws, but it also has problems with devices and the internet in general, which makes their harms far more abundant than benefits. For example, it is stated that “while our phones offer convenience and diversion, they also breed anxiety” (Carr 582). In addition, “as the brain grows dependent on the technology, the research suggests, the intellect weakens,” and “the division of attention impedes reasoning and performance” (Carr 583). Therefore, these device-related problems are multiplied a hundredfold by the fact that social media amplifies distraction and attention division through notifications. Social media is not a highly intellect-strengthening medium either, which further complicates the dependence factor.

Fourthly, social media companies are not properly regulated, and the nature of the business heavily favors oligopoly rather than a proper competitive environment because people want to have a unified platform for communication and audience-building. Therefore, the industry generates highly powerful companies with unchecked capabilities, where the national and even international discourse takes place exclusively on such mediums. For example, one cannot deny the influence of Twitter or Facebook as drivers of political or social discourse. Therefore, there is a conflict of interest among such big tech companies in regards to providing an open and fair platform versus making a profit, and the decision is clearly made in favor of the latter. The very structure of the business model of social media is to influence users to buy the advertisers’ products or services, and thus, it cannot be a just and fair place for discussion on important subjects by definition. Such a state of affairs threatens the fabric of society whether or not these companies intend to do so.

Fifthly, the conflict of interest described in the previous section brings its biggest harm when it comes to the First Amendment of the United States Constitution, where private enterprises are not obliged to protect the freedom of speech and expression. Since the national and international discourse and communication are taking the place of social media, where the First Amendment is mandatory to have, these platforms are unable, unwilling, and not obliged to provide it. One can easily observe how such companies can become politically tilted towards one agenda over the other, where accounts of even the most influential individuals can be banned because they violated the terms of service of the company. Once again, the business model of social media companies is structured in such a manner that their primary customers are not users but advertisers. A former group is a form of product or service being sold to advertisers, which means that social media advances surveillance capitalism at its core. In a century where the right to privacy is constantly becoming a problem due to governmental antiterrorism interests, social media further threatens these fundamental rights. The problem is even more dangerous when one considers the ever-increasing cyber threat proliferation, which means a breach of security in a social media company endangers all of its users.

Seventhly, social media does not have a well-structured method of combatting misinformation since its primary incentive is to promote engagement and grab attention. Such companies want to have interesting pieces of information, which are better provided by misinformation since the truth is always more complex and intricate. Therefore, one can see how social media can become a breeding ground for people with agenda of public deception. In addition, these platforms would not have the capability to ensure the accuracy of information even if they were incentivized somehow. Public panic and political polarization are other phenomena that accompany social networks, and the catalyst for these occurrences is information received both directly by the subject and disseminated using modern social communication technologies.

With over 3.6 million individuals using social media, it's an expansive and active growing community around the world.  But social media is causing harm and distress to people's mental health. Social media is also manipulating people's thoughts and what they buy. Although young people appear to be increasingly using social media to communicate distress, particularly to peers, it is still harmful because some people don’t have the luxury of finding those types of people. Social media is quite harmful because “students who spent more time on Facebook were more likely to feel envious of others and worse about themselves” ( Bronfenbrenner center for translation research 1 ). Also, social platforms manipulate people, “YouTube videos were to convince me that ‘the Media is lying.’  people should respond by spending less time consuming ‘the media,’ and probably more time on YouTube. Since YouTube optimizes watch time, these videos will become highly recommended”(How Algorithms Can Learn to Discredit the Media pg 2). Although social media gives young people a place to communicate distress on social platforms, it is quite harmful because young people are manipulated into consuming more media and wanting a better body image.  

A distinct benefit of social media is its ability to develop care groups. Young teens around the world are using social media to aid other individuals, recent research shows, “Young people appear to be increasingly using social media to communicate distress, particularly to peers” (The good, the bad and the unknown 2). People construct communities to support each other on social media. In addition, social media’s ability to bring small groups of singled-out individuals who are dealing with similar problems to convene from around the world to assist each other with depression and feeling alone. To further my example of how social media benefits people is its ability to help youth seek out support and lessen the chance of self-harm.  The Bronfenbrenner Center for Translational Research states, “Social media can have a positive impact on help-seeking and support provision, efforts to understand how to best minimize potential harm and maximize potential benefits are important next steps” (The Bronfenbrenner Center for Translational Research 2). As a society people should take measures to minimize harm to others and maximize the benefits of social media. 

One of the biggest negatives about social media is how it manipulates people. Platforms like Youtube try to convince users to believe something, and then show people videos on it to maximize watch time. Some users report that social platforms were trying to manipulate them.  Guillaume Chaslot said  “YouTube videos were trying to convince me that the Media is lying. I would respond by spending less time consuming the media  and probably, more time on YouTube.” Since YouTube optimizes watch time, these videos will become highly recommended” (How Algorithms Can Learn to Discredit the Media pg 2). Algorithms make people spend more time on the platform by showing them what they want to see and hear. This is important to know because people are being shown one point of view and it narrows their minds. An additional example is that technology manipulates people's ideas of their bodies.  Sites like Instagram and Snapchat use filters to enhance nice facial features and make people look better while hiding imperfections. Jia Tolentino states “I told Smith that I couldn’t shake the feeling that technology is rewriting our bodies to correspond to its interests—rearranging our faces according to whatever increases engagement and likes. “Don’t you think it’s scary to imagine people doing this forever?”(The Age of Instagram Face 3) Technology is trying to make people look better in its internist.  It manipulates how we think people should look. It creates a standard people think they have to live up to, but can't, and it makes people feel bad.  Social media is manipulating people's minds and thoughts by using tools like algorithms and filters.  

Social media has shown that it severely affects people's mental health. The more time spent on social media the more envious and worse we will feel about ourselves. Facebook is making people feel worse about themselves, causing their mental health to deteriorate.  Combined with social platforms’ impact on mental health it’s no coincidence suicide and suicidal thoughts have been going up. As is shown the “Number of young people admitted to the hospital for attempting suicide or having suicidal thoughts has doubled in the past 10 years”(The Bronfenbrenner Center for Translational Research 3). Technology is connected with higher suicide rates. It heavily affects people's mental health and body imagery causing suicide and depression.

Just How Harmful Is Social Media? Our Experts Weigh-In.

A recent investigation by the Wall Street Journal revealed that Facebook was aware of mental health risks linked to the use of its Instagram app but kept those findings secret. Internal research by the social media giant found that Instagram worsened body image issues for one in three teenage girls, and all teenage users of the app linked it to experiences of anxiety and depression. It isn’t the first evidence of social media’s harms. Watchdog groups have identified Facebook and Instagram as avenues for cyberbullying , and reports have linked TikTok to dangerous and antisocial behavior, including a recent spate of school vandalism .

As social media has proliferated worldwide—Facebook has 2.85 billion users—so too have concerns over how the platforms are affecting individual and collective wellbeing. Social media is criticized for being addictive by design and for its role in the spread of misinformation on critical issues from vaccine safety to election integrity, as well as the rise of right-wing extremism. Social media companies, and many users, defend the platforms as avenues for promoting creativity and community-building. And some research has pushed back against the idea that social media raises the risk for depression in teens . So just how healthy or unhealthy is social media?

Two experts from Columbia University Mailman School of Public Health and Columbia Psychiatry share their insights into one crucial aspect of social media’s influence—its effect on the mental health of young people and adults. Deborah Glasofer , associate professor of psychology in psychiatry, conducts psychotherapy development research for adults with eating disorders and teaches about cognitive behavioral therapy. She is the co-author of the book Eating Disorders: What Everyone Needs to Know. Claude Mellins , Professor of medical psychology in the Departments of Psychiatry and Sociomedical Sciences, studies wellbeing among college and graduate students, among other topics, and serves as program director of CopeColumbia, a peer support program for Columbia faculty and staff whose mental health has been affected by the COVID-19 pandemic. She co-led the SHIFT research study to reduce sexual violence among undergraduates. Both use social media.

What do we know about the mental health risks of social media use?

Mellins : Facebook and Instagram and other social media platforms are important sources of socialization and relationship-building for many young people. Although there are important benefits, social media can also provide platforms for bullying and exclusion, unrealistic expectations about body image and sources of popularity, normalization of risk-taking behaviors, and can be detrimental to mental health. Girls and young people who identify as sexual and gender minorities can be especially vulnerable as targets. Young people’s brains are still developing, and as individuals, young people are developing their own identities. What they see on social media can define what is expected in ways that is not accurate and that can be destructive to identity development and self-image. Adolescence is a time of risk-taking, which is both a strength and a vulnerability. Social media can exacerbate risks, as we have seen played out in the news.

Glasofer : For those vulnerable to developing an eating disorder, social media may be especially unhelpful because it allows people to easily compare their appearance to their friends, to celebrities, even older images of themselves. Research tells us that how much someone engages with photo-related activities like posting and sharing photos on Facebook or Instagram is associated with less body acceptance and more obsessing about appearance. For adolescent girls in particular, the more time they spend on social media directly relates to how much they absorb the idea that being thin is ideal, are driven to try to become thin, and/or overly scrutinize their own bodies. Also, if someone is vulnerable to an eating disorder, they may be especially attracted to seeking out unhelpful information—which is all too easy to find on social media.

Are there any upsides to social media?

Mellins : For young people, social media provides a platform to help them figure out who they are. For very shy or introverted young people, it can be a way to meet others with similar interests. During the pandemic, social media made it possible for people to connect in ways when in-person socialization was not possible.  Social support and socializing are critical influences on coping and resilience. Friends we couldn’t see in person were available online and allowed us important points of connection. On the other hand, fewer opportunities for in-person interactions with friends and family meant less of a real-world check on some of the negative influences of social media.

Whether it’s social media or in person, a good peer group makes the difference. A group of friends that connects over shared interests like art or music, and is balanced in their outlook on eating and appearance, is a positive. – Deborah Glasofer

Some people find these groups to be supportive; for others, it’s more beneficial to move on and pursue other interests.

Is there a healthy way to be on social media?

Mellins : If you feel social media is a negative experience, you might need a break. Disengaging with social media permanently is more difficult­—especially for young people. These platforms are powerful tools for connecting and staying up-to-date with friends and family. Social events, too. If you’re not on social media then you’re reliant on your friends to reach out to you personally, which doesn’t always happen. It’s complicated.

Glasofer : When you find yourself feeling badly about yourself in relation to what other people are posting about themselves, then social media is not doing you any favors. If there is anything on social media that is negatively affecting your actions or your choices­—for example, if you’re starting to eat restrictively or exercise excessively—then it’s time to reassess. Parents should check-in with their kids about their lives on social media. In general, I recommend limiting social media— creating boundaries that are reasonable and work for you—so you can be present with people in your life. I also recommend social media vacations. It’s good to take the time to notice the difference between the virtual world and the real world.

Media makes making friends so much easier because you get over that awkwardness you’d get talking face to face and getting to know each other before you meet up with them. Social media just is not bad because some people can just use social media to grow and promote what they love, or use it for a support system, and also us use to feel connected to the world when they cant go somewhere

Social media can be good because some kids/adults can rely on it when they need support from someone or something that won’t judge them. Like most people have said ”Spreading awareness and motivating people is important too. And simply ensuring people that they are not alone – or the only ones with their set of problems – can be really important for some.Caroline Knorr said , “It overall provides genuine support to others. This sort up ties with wanting online acceptance like whether a kid like a certain thing that is considered weird tries to find someone who likes the same thing.

It’s also used to lift their confidence a little because when they show off their talent off they are saying they know people are watching but they don’t care. It’s giving them more power knowing they are the ones having courage putting it out there. Technology nowadays can just allow kids to share their work with a wider audience. They can even have an opportunity to collaborate with other people and just grow.

Social media can be good because when people can go somewhere because of any reason they go on social media to see what is happening. It makes them feel included to know what is happening so they try to be connected to the outside world. Regardless of location and religion, social networks help revive and preserve relationships with other people. It lets people know what is happening outside their door or wherever they are. It’s good that social media lets people know what is going on because if no one knows what’s going on around them it makes them feel useless. So this gives them a chance to not feel left out all the time.

So all in all, Social media is not bad all nad. Especially for kids who need help-seeking for support . Also, how is it bad when you can try and grow your business on it even if you want to get to know and show off your talent. Social media is also considered a place you go to see what is happening in the outside world when your not with your friend it just lets you stay connected. People can’t automatically say social media is bad because it has so many myriad things it brings to our lives. So no one can say it bad if they know people depend on it for good reasons like jobs and communication. You just can’t say it badly without thinking of how other people see social media. Everyone who likes social media has a different perspective on it.

Have you ever found yourself needing to write an essay where you convince the reader of your point of view? Then, persuasive writing is what you need!

A persuasive essay or text aims to convince the person reading your words that a particular point is correct. It’s one of the oldest forms of writing and has been used in politics, business, and religion over the years.

Despite there being different types of persuasive writing, they all have one thing in common: allowing the reader to understand (and believe) the writer’s position on any given matter.

But, there is a time and a place for each type, and you need to know when to choose which one to achieve your goals.

Read on to learn more about the three main techniques used for persuasive writing and how to hone your writing skills to have people believe your point of view.

What Is Persuasive Writing?

Persuasive writing is any text that convinces the reader of the writer’s opinion.

There are different techniques and types, which will be discussed later, but each is intended for a specific context and purpose.

For example, if you are trying to get an extension on your essay deadline, you will write an email with a formal tone of voice to your professor. If you’re convincing your roommate to go grab a drink, your text will be far more informal.

You may not even notice it, but persuasive writing is all around us – in the media, in advertisements, in the news, and on social media.

No matter your purpose or context, all persuasive writing has the following in common:

• Evidence to back your claims
• Appealing to the reader’s emotion
• Logical arguments

Why Is Persuasive Writing Important?

Whether you’re a high school student or new to the working world, persuasive writing is an invaluable skill to have in your toolkit.

You may have to write convincing and/or persuasive essays for school to score top marks, or you have to write a convincing cover letter to go with your resume to get the job of your dreams.

But it’s more than that. Knowing how to write in a way to convince others of your personal opinion is a good way to sharpen your writing and negotiation skills. It teaches you how to research, fact-check, and construct concise and clear arguments – tools you can use your entire life.

If you end up in marketing or content writing one day, it is a good tool to have in your writing arsenal. But even if you turn towards charity work, you can use your persuasive writing skills to get donations and rally people to your cause.

3 Types Of Persuasive Writing Techniques

There are three main types of persuasive writing techniques, dating back to ancient Greece. These are:

The Greek philosopher Aristotle coined these terms back in the day, but they are still very applicable today when it comes to argumentative essays or any kind of text that needs to convince the reader.

Most persuasive writing examples use a variety of these techniques, as the combination of them strengthens your arguments.

“Ethos” is the Greek word for “character.” This technique uses writing that appeals to the reader’s character and virtues. For that reason, this style of writing is also called “ personal appeal. ”

This kind of writing plays on the reader’s sense of right and wrong. The writer establishes themselves as a trustworthy and knowledgeable character, and because of that, the readers will agree with what they have to say.

Some examples of ethos writing include:

• “My family has been farming in Texas for four generations, and I’ve been working in food production for 25 years. So, trust me when I say that we need to avoid genetically modified produce.”
• “I spent my entire childhood and most of my teenage years in Eureka Springs. I know most of you from school. Please, listen to me when I say: we need to put money towards restoring the Winona Springs Church – you all know it’s the right thing to do.”

Pathos means either “suffering” or “experience” in Greek. This type of writing targets the emotions of the reader, which is why it’s also called “ emotional appeal. ”

The goal of this type of writing is to trigger an emotional response in the reader, which causes them to trust what you have to say.

You can influence readers by eliciting a variety of emotions, including:

Here are some examples of how you can use the pathos technique in persuasive essays:

• “Are you really willing to stand by and watch as millions of unwanted dogs in the Humane Society shelters are euthanized each year?”
• “Business owners say Gen Z is scared to work, but the real reason is that they’re not paying their staff fair wages.”

“Logos” is the origin of the word “logic”. This technique is also called “ logical appeal. “It is mainly focused on logical arguments, presenting facts to convince the reader that you are speaking the undeniable truth.

Each statement that is written is backed up by facts, enhancing the writer’s credibility.

It’s possible that a writer may twist facts to fit in with their narrative, but many readers can spot this manipulative style of writing.

Some examples of the logos technique are:

• “If you know nicotine is bad for your health, why are you still grabbing your vape as soon as you wake up?”
• “Passenger cars emitted 374.2 million metric tons of CO2 in 2021. If we truly want to slow down climate change, we need to skip the short car trips to the store and walk instead.”

Bonus technique: Kairos

So, this technique wasn’t grouped by Aristotle with the three discussed above. However, he did believe that this was a fourth way to persuade readers to see your point of view.

The Supreme Court’s June Opinion Dump Will Be Devastating and Unprecedented

The Supreme Court is about to drown us in a deluge of explosive and massively consequential decisions involving some of the most controversial issues of the day. Right now, the justices are scrambling to complete blockbusters involving abortion , guns , homelessness , unions , social media , online disinformation , pollution , the administrative state —and, oh yes, hundreds of Jan. 6 prosecutions, including Donald Trump’s . Yet at the moment, there’s a logjam: The court, which likes to wrap up decisions by the end of June, is way behind schedule, releasing just a trickle of minor cases several weeks in a row. Even if it stretches into early July this year, SCOTUS has teed up a chaotic finale to the term. As soon as the current logjam breaks, the court will dump everything on us all at once.

This approach to judging—to ruling , really, in the monarchical sense —is both disgraceful and unnecessary. It’s disgraceful because regular people cannot possibly absorb the enormous amount of material that is poised to gush out of the court, as the justices surely know, much of it dressed up in legalese to obscure its meaning for nonlawyers. The overwhelming majority of Americans will have no hope of keeping up with the sweeping and complex decisions to come, even if those decisions have direct and negative impacts on their lives. And this inundation is unnecessary because the justices pick their own arbitrary deadline, then fail to manage the docket in a way that allows them to meet that deadline without cutting corners and overwhelming the news cycle with a glut of last-minute bombshells. The conservative supermajority has a checklist to clear, and it won’t temper its agenda to accommodate for a (gratuitously) tight timeline. Its smash-and-grab attitude toward the law requires aggressive, immediate intervention in cases that the court has no good reason to hear. And so this June, and maybe July, is shaping up to be an unprecedented season of ceaseless SCOTUS mayhem.

A glimpse at the term’s remaining cases shows what a nightmare we’re in for. The justices are preparing to hand down roughly 14 extraordinarily high-profile opinions, triple or quadruple the number of an ordinary term. A decade ago, June’s biggest decision was Burwell v. Hobby Lobby , allowing corporations to limit contraceptive coverage for employees; this year, there are at least a half-dozen cases that stand to eclipse Hobby Lobby in terms of impact and controversy. (Maybe a lot more, depending on how far the supermajority swings right.)

The problem, as Georgetown Law professor Steve Vladeck has explained , is that the Supreme Court has fundamentally altered its approach to granting cases in recent years. It used to be that the justices primarily took up small cases to clarify muddled areas of law, topped off with a handful of blockbusters. Today, they’re taking up fewer and fewer little cases while maxing out on the front-page supernovas. So areas of the law that are important within the legal system but uninteresting to most people, like the Fourth Amendment’s protections against unreasonable search and seizures, remain muddy, because the justices can’t be bothered to deal with them. Meanwhile, the court wades into contentious disputes where it has no business interfering. And big decisions typically provoke longer opinions plus concurrences and dissents, which must circulate for weeks or months as the justices respond to one another. Thus, the docket is smaller than ever, yet the justices say they are as busy as ever , because they can’t help but reach out and grab the shiny toys.

In fairness, there are some major cases that the court can’t avoid. The U.S. Court of Appeals for the 5 th Circuit, for instance, keeps jamming the justices with crazy decisions; as the adult in the room, SCOTUS feels an obligation to take up and reverse these rulings. Some attention-grabbers on the docket this term came straight from the Fightin’ 5 th Circuit , including decisions limiting access to medication abortion and granting domestic abusers the right to bear arms. There are, however, a ton of other big cases this term that the Supreme Court had zero compelling reasons to take. Why, for example, did the court decide now was the time to let states criminalize homelessness ? Or make it harder to halt illegal, union-busting, anti-labor tactics? Or consider whether to preemptively kill a wealth tax , using a dispute built on bogus facts ? There was nothing urgent about any of these cases or the underlying issues, no reason the court could not put them off for another day. The conservative justices were, it appears, simply eager to bend the law rightward in each instance and stacked them atop one another in the same overstuffed term to get the job done ASAP.

No cases better illustrate this phenomenon than Loper Bright Enterprises v. Raimondo and Relentless v. Department of Commerce . Both involve challenges to a federal program that required the fishing industry to share the cost of compliance monitors onboard their vessels. Conservative lawyers developed both as a challenge to Chevron deference, the 40-year-old principle that courts must defer to federal agencies’ reasonable interpretation of ambiguous laws. Overturning Chevron deference would make it harder for presidents to interpret and enforce the law, in turn limiting the government’s ability to protect the public. This power grab is high on the Republican Party’s wishlist because it will kneecap countless regulations that protect us from pollution, fraud, exploitation, discrimination, and other societal ills.

It’s no secret that the Supreme Court’s Republican-aligned bloc is hungry to overrule Chevron. So hungry, in fact, that it initially took up a case from which Justice Ketanji Brown Jackson had to recused, Loper Bright Enterprises . (She participated in an earlier stage while serving on a lower court.) Recognizing, perhaps, that they should not reverse landmark precedent with a short-staffed court, the conservative justices later took up an identical “companion” case, Relentless . They therefore burdened themselves with double the briefing and double the arguments, enlarging their (already heavy) workload. Worse yet, the two cases do not even involve a live dispute . A ruling in favor of the fishing industry will do nothing for the parties. The case is entirely theoretical, a faux-dispute manufactured for the sole purpose of overturning Chevron . And it could not wait till next term: The court had to gobble it up now .

Less wonky but just as egregious is SCOTUS’s intrusion into the Jan. 6 cases. It abruptly decided to jeopardize the prosecution of more than 350 defendants from the Capitol riot by gutting the federal obstruction law under which they’ve been charged. The lower courts reached a near-unanimous consensus that the Justice Department used this law appropriately; the Supreme Court’s intervention was totally unwarranted and may signal broader hostility toward accountability for the insurrectionists. That obstruction law also lies at the heart of special counsel Jack Smith’s indictment of former President Donald Trump for election subversion; eviscerating the statute will eviscerate a key part of the indictment.

Of course, thanks to the Supreme Court, it’s not even clear that Smith will ever prosecute Trump for his alleged crimes relating to Jan. 6. And this sin, too, is partly a story of devious docket management. After the U.S. Court of Appeals for the D.C. Circuit denied Trump’s absurd claim of presidential immunity in February, SCOTUS could (and should) have denied Trump’s appeal. Or it could have quickly, summarily affirmed the D.C. Circuit’s decision. Or it could have taken up the case on the same fast-track schedule it used to keep Trump on the ballot in Colorado. But it didn’t. Rather, the Supreme Court took up the case on a more drawn-out schedule, hearing arguments in late April, with a decision likely in late June. The former president’s arguments in this case are so frivolous that a responsible SCOTUS would have disposed of the whole thing months ago. Instead, the court has treated Trump’s claim as plausible , maybe even persuasive, bogging itself down with a distraction of no merit and monumental importance.

Last month, Vox’s Ian Millhiser made the important point that the right’s evolving approach to judicial nominations has had an immense, underacknowledged impact on the court’s docket. Conservative justices now join the Supreme Court with both a rigid ideology and an agenda toward which they are disinclined to compromise. We all saw this phenomenon play out with the rushed reversal of Roe v. Wade . The impact, though, goes much deeper: It leads to a court that acts much more like a legislative body, picking and choosing which legislation to prioritize, than an impartial judiciary resolving genuine conflicts that come before them. The downstream effects are ugly—but then, why shouldn’t right-wing lawyers engineer phony cases when sympathetic justices are begging for any excuse to rip up precedent, no matter how flimsy the pretext?

As we await the coming torrent of toxic opinions, we should bear this fact in mind: The pile-up of blockbusters did not happen by accident. It is the direct result of a cynical approach to the docket that front-loads the right-wing bloc’s priorities. The court’s composition could change at any time; some conservative justices surely remember when Justice Antonin Scalia died suddenly, denying them a fifth vote in pending cases. And so they flood the zone, never putting off until tomorrow what they could do today. We are about to see the grisly consequences of these tactics. And we will be forced to live with them for long after that.
